In a brief relief to 20 disqualified AAP MLAs, the Delhi High Court on Wednesday directed the Election Commission of India not to issue any notification for bypolls in the constituencies held by these legislators until it decided on the matter.
The court will resume its hearing on Monday next week. The HC also sought reply of all respondents including the EC on the plea of the disqualified MLAs, reported ANI.
The MLAs had moved the High Court on Tuesday after President Ram Nath Kovind on Sunday gave his approval to the EC’s recommendation on their disqualification for holding offices of profits.
The AAP MLAs also requested the court to cancel their disqualification while also ordering the EC to allow them to submit their defence. The EC reportedly told the HC that it had no plans to issue any notification for bypolls in the next three days.
“Respondent number 1 (the EC) has acted contrary to the principles of natural justice by wilfully depriving the petitioners to submit oral submissions,” the legislators’ petition filed through counsel Manish Vashist argued.
